Here's what we know


The new ordinance applies to prisoners convicted of both felonies and misdemeanors. Inmates would only have to pay after spending 72 hours in prison.

Sheriff Rich Kelly told WTTV-TV that he believed this new policy would save taxpayers money, and provide an extra deterrent to crime. "If it deterred one person from making a bad decision than it is worth it to me," Kelly said.

Clinton County is not the first prison to implement this policy. Critics have argued that it discriminates against poorer inmates. The ACLU has protested the move. 

ACLU Indiana executive director Jane Henegar told WXIN-TV that this policy would burden inmates "with excessive and unnecessary debt to solve a problem of our own making, not the individual's." She called this "cruel and just bad policy." The ACLU said that "[a]dding a bill of over $10,000 per year makes it that much harder to re-enter society."

But Kelly dismissed accusations that the fee was excessive. "As far as them incurring debt, that's a responsibility that every adult has. We all incur debt," he said. Kelly claimed that upkeep at the jail costs residents in the county $4 million annually.
County Commissioner Joshue Uitts has insisted that this new policy is in line with existing Indiana law.

At a rate of $30 per day (minus the first 72 hours), inmates would have to pay $810 for a 30-day sentence, and $10,860 for a year.

This new system is scheduled to take effect in August. The Clinton County jail can hold more than 150 inmates at one time.

    It's just plain stupid.

    How would you ever even collect?

    This was the practice of British prisons and why there was NO HONEST COURT in England--- everyone was convicted .......... for PROFIT.

    Yeah sure, the POLICE - --- Currently, in the U.S., law enforcement kills around 1,200 citizens per year. Ironically, that number is actually four times higher than those who die from rifles. As has been recorded, cops have killed 450 percent more people than have died in the past forty years of mass shootings.
    So now I say why are the football fans not kneeling WITH the players? After Ruby Ridge, Waco, LaVoy Finicum and the Bundy Ranch ALL fans should be joining the Players arm in arm and demanding the "police" start serving ALL the Citizens. The "Thin Blue Line" should be dismantled by any means necessary. There should be througho and objective THIRD PARTY investigations of shootings.
    The police have NO Constitutional obligation to protect you/your loved ones. The police can legally stand and watch your loved ones be beaten to death and there is NO recourse. "all that needs to be understood, and remembered is they are armed, and paid, to protect and serve the State. you are not the State. once that is thoroughly understood, the rest falls into place."

  6. A friend of mine was in a county jail for 93 days and they sent her a bill for $5K!!! of which she couldn't pay. They sued her in court and got a lien on her for 20 years... and shortly after that the county stopped this ludicrous practice.... but she was stuck with the judgment!!!

  9. The county initiated this "policy" and then about 6 months or less later they dropped it. That was almost 20 years ago now....so don't bother.

  10. then it's not binding, if there is so called legislation "ie a statute" i can neuter a statute in under three minutes.. find out if this is by legislative fiat and get me the statute.
    if it's by institutional policy, its still not binding and could never be an obligation.

  15. Any time a person is freed for wrongful conviction the Prosecutor, and possibly the Judge & police should be made to serve that Person's FULL SENTENCE.

  22. Hire a Mexican to do your time or join the Army for you, the new minimum wage in Mexico is $5 a 10 hour day.
    You save $25 a day.
    The Mexican gets a prison job,clothes,shelter,food,medicine and a pathway to hell.
